The proliferation of mass tort lawsuits has inflicted a terrible burden on the American economy by driving up the cost of doing business. According to a report by the White House Council of Economic Advisors, “The cost of the U.S. tort liability system as a percentage of GDP is more than double the average cost of any other industrialized nation.” Companies facing these lawsuits risk reputational damage and quantifiable financial harm. It’s imperative that companies be able to defend themselves in order to minimize the long-term implications of such cases.
